Preparation Requirements

Identify the Real Estate Document

Common documents include property deeds, mortgage documents, mortgage satisfactions, real estate powers of attorney, property ownership statements, and certified land records.

Recorded Property Deeds

For a deed that has already been recorded, request a certified copy from the Alabama county probate office maintaining the property record.

The certified copy should include the appropriate official certification, signature, and seal.

Mortgage and Property Records

Recorded mortgages, mortgage releases, and other property instruments should be obtained as certified records from the appropriate county probate office when official record certification is required.

Privately Executed Real Estate Documents

Documents that have not been recorded, including certain property declarations, authorization letters, and real estate agreements, may qualify through properly notarized signatures.

The document must be correctly executed and meet any applicable witness or acknowledgment requirements.

Real Estate Powers of Attorney

A Power of Attorney authorizing a real estate transaction may require an acknowledgment and compliance with Alabama's property conveyance requirements.

Confirm whether the receiving authority requires a particular form, additional witnesses, or specific execution language.

Alabama Notarization

Where the document follows the notarial apostille route, it must contain a properly completed notarization by a currently commissioned Alabama notary public.

The notary's original signature and official embossed or ink-stamped seal must be present.

Review the Certification

Make sure all pages are complete, readable, and accompanied by any required certification pages.

An ordinary photocopy or uncertified online property-record printout may not be sufficient.

Foreign-Language Documents

Documents written in a foreign language must be accompanied by a notarized English translation when presented for Alabama authentication.

Important Information

Real estate documents can have separate legal execution, recording, and apostille requirements. National Apostille Center can review the document before processing to help determine the appropriate certification route.

Required Certification

Certified County Property Records

Recorded deeds, mortgages, and other land records should be obtained as officially certified copies when the receiving authority requires a certified public record.

Alabama Probate Judge Certification

The Alabama Secretary of State accepts eligible documents bearing the original signature and official seal of a currently commissioned Alabama probate judge for apostille purposes.

A property-record certification signed by another county official may need further review.

Alabama Notary Public

Privately executed real estate documents may qualify for an Alabama apostille when they bear a properly completed notarization by a currently commissioned Alabama notary public.

Original Signature and Official Seal

The Alabama Secretary of State requires the original signature and embossed or ink-stamped seal of an eligible Alabama public official.

Acknowledgment and Execution Requirements

Deeds, real estate powers of attorney, and other conveyance-related documents must satisfy applicable execution requirements.

Apostille eligibility does not replace requirements for witnesses, acknowledgment, recording, or legal validity.

County Authentication

Additional county authentication of an Alabama notary's commission is generally not required for an apostille.

For notarized documents requiring certification for a non-Hague country, the state requires county authentication of the notary's commission.

Apostille Issuing Authority

Alabama Secretary of State — Authentication Division.

Important Notice

An apostille authenticates the public official's signature, seal, and official capacity. It does not establish property ownership, confirm the absence of liens, or guarantee the legal effectiveness of a real estate transaction.
